Who is responsible for mold from AC leak?« Back to Previous Page

My kids have been coughing for a couple of weeks, and I finally pulled our sofa away from the wall in the living room of our Discovery Gardens apartment. I found a huge patch of black mold spreading from the corner where the AC unit's pipe drips. We've been here for over a year and it's been fine, but it got way worse after the heavy dew last month. Who is legally responsible for fixing this and the damage to our furniture, us or the landlord?

Good afternoon. This is a very common and serious issue we encounter in Dubai, especially in high-humidity areas like Discovery Gardens. From your description, this is a significant mold colony, and the health symptoms in your children are a major concern that requires immediate action.

Legally, under UAE tenancy law, the responsibility for maintenance of the main structural components and central air conditioning systems typically falls on the landlord. The AC condensate drain line is an integral part of that system. Since the leak originates from this fixed installation, the landlord is generally responsible for repairing the leak at its source to prevent further damage. The resulting damage to the property itself (the wall) is also their responsibility to rectify.

However, the damage to your personal property—in this case, the sofa—can be more complex. This often depends on the specific terms outlined in your tenancy contract and whether it can be demonstrated that you reported a pre-existing issue with the AC in a timely manner. The recent heavy dew you mentioned is a contributing environmental factor but does not absolve the landlord of their maintenance obligations.

Your first step is to formally notify your landlord or property management company in writing with clear photographs of the mold and the leaking pipe. Do not attempt to clean the mold yourself, as improper disturbance can aerosolize the spores and worsen the air quality. For a infestation of this size and due to the health symptoms present, a professional inspection and remediation is strongly advised to ensure it is handled safely and effectively. We can provide a detailed report that can be used to substantiate your claim with the landlord.
