Is landlord responsible for mold from AC or insulation?« Back to Previous Page

Our bedroom closet on the outside wall has started to feel damp, and I just found a patch of black mold on the back of my winter jackets. We're in an older building in Jumeirah, and the dehumidifier runs constantly. I've read about the common AC issues here but I'm not sure if this is something I need to fix myself or if the landlord is responsible for addressing the root cause. Who is typically responsible for mold remediation in a rental, especially when it might be related to the building's insulation or AC system?

This is an excellent and very common question for older buildings in Jumeirah and across Dubai. The short answer is that the responsibility largely depends on the root cause, which requires a professional diagnosis.

In the UAE, the landlord is generally responsible for maintaining the structural integrity of the property. This includes the building's external envelope, insulation, and the fixed air conditioning system (the main unit, ductwork within the walls/ceilings, and FCU). If the mold is a direct result of poor building insulation allowing condensation (a huge issue here with our high humidity), a leaking AC drain pipe, or faulty ductwork causing moisture accumulation, then the remediation and repair fall squarely on the landlord. You should formally notify them in writing, as they are obligated under Dubai rental law to provide a habitable premises.

However, if the issue is due to tenant behavior—like insufficient ventilation, blocking AC vents with furniture, or not running the AC consistently (which is necessary here to manage humidity, even when you're out)—the responsibility for cleaning and preventing recurrence could be yours.

Given your description of a closet on an outside wall and a constantly running dehumidifier, this strongly points to a building envelope or AC issue. You absolutely need a certified mold inspection to identify the moisture source. DIY cleaning is a temporary fix; the mold will return unless the root cause is addressed. We use thermal imaging and moisture meters to pinpoint the exact issue, which provides the evidence needed to formally engage your landlord.
