Who pays for black mold removal, tenant or landlord?« Back to Previous Page

We've lived in this Discovery Gardens apartment for 2 years and just noticed a spreading patch of black mold in the corner of our master bedroom closet. It must have been there a while because our winter clothes stored in there have a really strong, damp smell. Who is responsible for getting this professionally treated and paying for it, me as the tenant or my landlord?

In the UAE, the responsibility for black mold remediation is typically determined by the cause of the moisture intrusion, as outlined in the standard tenancy contract and Law No. 26 of 2007. As a certified mold inspector, my first recommendation is to immediately engage a professional inspection to identify the source. The Dubai climate, with its extreme humidity and reliance on year-round air conditioning, is a significant contributing factor. The issue in your closet is likely due to one of two primary causes.

If the mold growth is a result of a structural defect, such as a leaking pipe within the wall, a faulty AC drain line from the upstairs unit, or inadequate insulation leading to condensation (a common issue where cold exterior walls meet humid interior air), then the financial responsibility falls upon the landlord to rectify the underlying defect and the resulting mold damage.

However, if the investigation determines the cause is tenant-related, such as insufficient ventilation within the enclosed closet space, storing damp items, or failing to regularly run the AC to control humidity levels, then the cost of remediation would be the tenant's responsibility. The strong, damp smell on your stored belongings suggests prolonged exposure, which necessitates professional remediation to prevent health risks and structural damage.

Given the complexity of identifying the source, a professional assessment is non-negotiable. Our team at Saniservice conducts comprehensive inspections, including moisture mapping and air quality testing, to provide a definitive report on causation. This report is essential for determining liability. Do not attempt to remove significant mold growth yourself, as improper handling can aerosolize toxins and spread contamination.
