Is landlord responsible for black mold and health issues?« Back to Previous Page

My kids have been coughing a lot lately and I’ve just discovered black mold growing along the bottom of the wardrobe in our master bedroom, which is right against the outer wall. We’ve lived in this Jumeirah Village Circle apartment for almost a year and it seems to be getting worse, especially after the recent humidity. Is the landlord responsible for fixing this and the potential health issues, or is this on me to handle?

This is a very common issue in Dubai, particularly in areas like Jumeirah Village Circle, and it's a serious concern due to the potential health implications for your children.

The responsibility for remediation typically falls on the landlord, as per standard tenancy contract obligations in Dubai. The landlord is responsible for maintaining the structural integrity of the property and addressing issues arising from inherent building defects. The mold along the outer wall strongly suggests a potential source of water intrusion, such as a leaking pipe within the wall, a crack in the building envelope, or inadequate external waterproofing and insulation, which is a structural defect. The recent high humidity has likely exacerbated an existing moisture problem.

However, tenant responsibilities include maintaining adequate ventilation to manage the high ambient humidity, which is a consistent challenge in our climate. Year-round AC use can lead to significant condensation if systems are not properly balanced or if ventilation is insufficient.

From a health perspective, the coughing is a significant indicator. Prolonged exposure to Stachybotrys chartarum (black mold) mycotoxins can cause chronic respiratory issues, especially in children.

Actionable steps: 1) Formally notify your landlord in writing about the issue, including photos, and request immediate remediation of the moisture source and mold. 2) Do not attempt to clean it yourself, as improper disturbance can aerosolize spores and worsen the indoor air quality. 3) A professional inspection is critical. We use thermal imaging cameras to identify the exact moisture source and conduct air quality testing to quantify spore counts and identify the mold species, which is essential for proper remediation and for addressing health concerns with your landlord.
