Is mold in my rental apartment the landlord's responsibility?« Back to Previous Page

We've lived in our apartment in Jumeirah Village Circle for two years, and just noticed black spots spreading on the wall behind the wardrobe in the master bedroom. The room has felt really damp lately, and I'm pretty sure it's mold. Is it my responsibility to clean this and fix the wall, or is this something the landlord needs to handle since it might be a building leak?

In the UAE, the responsibility for mold remediation in a rental property is typically determined by the cause of the moisture, as outlined in Dubai Law No. 26 of 2007 (Amended by Law No. 33 of 2008), known as the Dubai Rental Law. If the mold growth is a result of a structural defect, such as a leaking pipe within the walls, a faulty AC unit that is part of the building's infrastructure, or water ingress from the building envelope, the financial responsibility for the investigation and repair falls squarely on the landlord.

However, tenant responsibilities include maintaining adequate ventilation to prevent condensation, which is a major issue in Dubai's humid climate, especially when AC units are run continuously. If the mold is determined to be due to tenant behavior—such as failing to use exhaust fans, blocking AC vents with furniture (like your wardrobe), or not reporting a minor leak in a timely manner—you could be held liable for the damage.

Given your description of the black spots spreading behind the wardrobe and a persistent damp feeling, this strongly suggests a hidden leak or severe condensation issue. Do not attempt to clean it yourself, as improper handling can aerosolize toxic spores and worsen the problem. Your first step is to formally notify your landlord or property management company in writing about the issue, as this starts the legal clock for them to respond.

I strongly recommend a professional inspection to definitively identify the moisture source and the mold species. Our certified team at Saniservice uses thermal imaging, moisture meters, and air sampling to provide a forensic report that clearly establishes liability. This evidence is crucial for discussions with your landlord. For immediate assistance, please call us at 800-MOLDS or email hello@saniservice.com to schedule a comprehensive assessment.
