Is landlord responsible for mold removal costs?« Back to Previous Page

My kids have been coughing and I suspect it's because of the black mold I just found behind the wardrobe in our master bedroom. We've lived in this Jumeirah Village Triangle apartment for 2 years and just noticed it when we moved the furniture to clean. The dehumidifier runs constantly but it doesn't seem to help. Are we responsible for the cleaning and repair costs, or is this something the landlord has to fix?

Under Dubai's rental law, the landlord is typically responsible for addressing structural issues that cause mold, such as leaking pipes, faulty waterproofing, or poor ventilation in external walls. You, as the tenant, are generally responsible for maintenance due to daily living, like insufficient air circulation or not using AC appropriately.

Your situation in Jumeirah Village Triangle is common; the high humidity and constant AC use can lead to condensation behind large furniture placed against exterior walls, creating a perfect environment for mold. Since you've just discovered it after two years, the cause will determine responsibility. A persistent leak from another unit or within the wall would be the landlord's duty, while condensation from placing a wardrobe against a cold wall might be a shared discussion.

Document everything with dated photos and formally notify your landlord or property management company in writing. For health concerns like persistent coughing, a professional inspection is recommended to identify the mold species and moisture source. This provides an objective report that can clarify liability. Most reputable inspectors can pinpoint if the moisture is from infiltration (landlord's responsibility) or condensation (often a shared concern).

Landlords are usually cooperative when presented with evidence of a structural issue, as unresolved mold can cause greater property damage. Start the conversation by sharing your findings and requesting a diagnosis of the root cause.
