AC leak causing mold and allergies: landlord's responsibility?« Back to Previous Page

The AC unit in our bedroom in Jumeirah Village Circle has been leaking a little for a couple of months, and now we're seeing black spots spreading on the wall behind the wardrobe. My husband's allergies have been way worse since it started. Are we responsible for cleaning this and repairing the wall, or is this something the landlord needs to fix immediately?

Based on the details you've provided, this is a serious situation that requires immediate attention. The black spots are almost certainly active microbial growth, exacerbated by Dubai's high humidity and the constant moisture from the AC condensate leak. This is not just a cosmetic issue; it is a health hazard, as evidenced by your husband's exacerbated allergies.

Under UAE law, specifically Law No. (26) of 2007 Regulating the Relationship between Landlords and Tenants in the Emirate of Dubai (as amended), the landlord is unequivocally responsible for maintaining the property's structure and essential services, which includes the central air conditioning system and the integrity of the walls. The AC leak is a maintenance fault, and the resulting mold damage is a direct consequence. You are not responsible for the repairs to the AC unit or the structural remediation of the wall. You must formally notify your landlord or property management company in writing of the issue immediately, as it constitutes a breach of their obligation to provide a habitable premises.

However, for your health and safety, professional assessment is critical. The mold behind the wardrobe is likely just the visible portion; the growth probably extends into the wall cavity. Disturbing it improperly can aerosolize spores, drastically worsening indoor air quality and allergy symptoms.

We strongly recommend you contact a professional environmental inspection company like Saniservice. Our certified experts can conduct a comprehensive inspection, including air and surface sampling, to identify the species and extent of contamination. This provides an official report you can present to your landlord, documenting the health risk and necessary remediation scope. Do not attempt to clean this yourself with bleach, as this will not address the root moisture problem and can be hazardous.
