Am I justified in asking landlord to fix mold?« Back to Previous Page

After the recent heavy rains, I noticed a mildewed smell coming from under the kitchen sink in my rented apartment. The landlord hasn't responded to my messages about it, and I’m not sure if this is something I should address on my own or if they are responsible for these kinds of maintenance issues. Given that we’ve lived here for 2 years and just noticed this, am I justified in asking them to take care of it?

Absolutely, you're well within your rights to request the landlord address this issue. In the UAE and specifically in Dubai, properties are expected to be maintained in a safe condition for tenants. The real estate law (Federal Law No. 7 of 2003) mandates landlords to ensure that their property is in a good state of repair and free from hazards such as mold.

Given your situation, it would be wise to take the following steps:

Firstly, document the extent of the mildew with photos or videos. This evidence can be crucial if you need to present your case later on. Make sure to include details like the location of the mold, its size, and any visible damage it might have caused.

Secondly, send a formal written notice to your landlord requesting immediate action to address the issue. In Dubai, it's common for tenants to use email or certified mail for such communications to ensure proof of delivery. Include references to relevant property maintenance laws to back up your request.

If the landlord does not respond within a reasonable timeframe (typically 7-14 days), you may want to escalate the matter by contacting local authorities. The Dubai Municipality can provide guidance and, in some cases, intervene if a tenant's complaints are unresolved. Additionally, you could seek assistance from consumer protection services or legal counsel.

In serious cases where mold has been identified as hazardous, professional inspection and remediation might be necessary. Mold can pose significant health risks, especially for individuals with allergies, asthma, or compromised immune systems. In the UAE, companies like Saniservice (you can reach them at 800-MOLDS or email hello@saniservice.com) are well-versed in dealing with such issues and can provide safe and effective solutions.

Remember, while you have the right to request repairs, it's also important to handle the situation professionally. Avoid making accusations that might escalate into conflicts; instead, focus on the health and safety aspects of the issue.

Lastly, keep records of all communications regarding this matter, including dates, times, and any responses received from your landlord or other parties involved. This will help you track progress and provide evidence if necessary.
