Am I or my landlord responsible for bedroom mold?« Back to Previous Page

The wall behind my wardrobe in the bedroom has a huge black splotch of mold that seems to be spreading. I first spotted it a couple of weeks ago, but with all the humidity lately, it's gotten much worse. We've been in this Jumeirah Village Circle apartment for three years and never had an issue before. Am I responsible for the cleanup, or is this something I need to get my landlord to handle?

Responsibility depends on the source of the moisture. Under Dubai rental law (Law No. 26 of 2007), landlords are responsible for fixing structural issues, like a leaking pipe inside the wall or faulty external waterproofing, that cause the dampness leading to mold. Tenants are typically responsible for issues stemming from their own actions, like inadequate ventilation leading to condensation.

Given the location behind a wardrobe, this is a common spot for condensation in Dubai's climate. Airflow is restricted, and the cold wall from constant AC use meets warm, humid air, creating the perfect environment for mold. Since you've had no issues for three years, the recent high humidity is a likely culprit.

For a splotch that is large and spreading, a professional inspection is recommended to identify the exact moisture source. They can use moisture meters and thermal cameras to determine if it's condensation or a hidden leak. This evidence is crucial for discussing responsibility with your landlord.

First, notify your landlord in writing with clear photos, as this is a habitability concern. They should arrange an inspection. If they determine it's structural, they must fix it. If it's deemed condensation, you may be responsible for the cleanup, but remediation is advised due to the size. Simply wiping it often spreads spores. Proper remediation involves containment, HEPA vacuuming, and antimicrobial treatment to prevent regrowth.
