Am I or my landlord responsible for black mold?« Back to Previous Page

My kids have been coughing and I suspect it's because of the black mold I just found behind the wardrobe in our master bedroom. We've lived in this Discovery Gardens apartment for 2 years and just noticed it when we moved the furniture to clean. The wall feels damp, and it's been getting worse since the humidity started rising a couple of weeks ago.
Am I responsible for the cleaning and repairs, or is this something I need to report to my landlord?

Responsibility typically depends on the source of the moisture. Under Dubai rental law (Law No. 26 of 2007), landlords are responsible for the structural integrity of the property, including fixing leaks in plumbing, roofs, or external walls that cause dampness. Tenants are generally responsible for issues stemming from their own negligence, like interior water spills or failing to use AC properly to manage humidity.
Since the wall behind the wardrobe feels damp and you've noted rising humidity, this points to a potential building envelope issue or condensation, which is very common here. Your first step is to formally report it in writing to your landlord or property management company immediately. Include clear photos and mention the damp wall. This creates a paper trail. They are usually obligated to investigate and fix the root cause, such as a leaking pipe or inadequate insulation. For the mold remediation itself, the responsibility for cleanup can be negotiated, but addressing the underlying moisture is the landlord's legal duty. Given the health symptoms and visible growth, a professional inspection is wise to identify the exact moisture source and mold type. Do not attempt to clean significant black mold yourself with bleach, as this can aerosolize spores. A proper remediation plan from a certified provider will isolate the area, remove contaminated materials, and treat the space to prevent recurrence. Focus your discussion with the landlord on fixing the leak first; the cleanup can follow. |
