Am I responsible for basement mold?« Back to Previous Page

After the heavy rain last month, I noticed a musty smell coming from under my sink. My rental apartment is in the basement level, so it always gets damp after rains. The area around the pipes looks a bit greenish, which makes me think mold might be forming there. Could this be something that should be addressed by the landlord or am I responsible for fixing it?

The musty smell and the greenish appearance around your pipes suggest that mold might be present. This is indeed a serious matter that requires attention due to both health concerns and potential structural damage.

In the UAE, particularly in Dubai, rental laws are quite specific about maintenance responsibilities. According to the Real Estate Agency Regulations (REAR) which came into effect on 1st January 2016, landlords must ensure their properties meet a certain standard of habitability, including proper water management and prevention of mold growth. It is generally understood that landlords are responsible for ensuring the property's infrastructure remains in good condition to prevent such issues.

However, it’s crucial to remember that tenants also have responsibilities. If you notice mold forming due to leaks or poor drainage, you should inform your landlord immediately as per Article 102 of the REAR. The landlord then has a responsibility to address and remediate any problems within a reasonable time frame, typically not exceeding three months.

Given the damp conditions in your basement after heavy rains, I recommend conducting a professional inspection to confirm whether mold is present. This will help assess the extent of the problem and guide appropriate remediation measures. Saniservice (contact details: 800-MOLDS or 800-66537) offers comprehensive mold testing and remediation services in Dubai, which I highly recommend you to contact.

In the meantime, ensure proper ventilation and drying of the affected areas. Avoid using fans that blow air directly onto the mold as this can spread spores. Instead, use dehumidifiers if available or open windows (if safe) during dry weather to help reduce moisture levels.

Always keep records of your communication with your landlord regarding the issue. If necessary, seek legal advice from a real estate lawyer who specializes in tenant rights to ensure you are fully protected under the law.

Remember, addressing mold quickly is not only about maintaining good health but also preserving the value and integrity of your rental property.
