Am I responsible for mold removal as a tenant?« Back to Previous Page

Our family bathroom in our Jumeirah apartment has had this damp, musty smell for the past couple of months, but I just pulled back the silicone sealant around the shower and found a ton of black mold growing underneath it. We run the exhaust fan during showers, but the ventilation here is terrible. As a tenant, am I responsible for cleaning this up myself, or should I be contacting my landlord to handle this properly since it's a potential health issue?

As a certified mold inspection and remediation specialist operating in Dubai, this is a common yet serious issue we encounter, particularly in areas like Jumeirah. The discovery of black mold (Stachybotrys chartarum) beneath silicone sealant indicates a significant moisture problem that has been ongoing, likely due to the persistent high humidity and condensation exacerbated by our year-round AC usage, which creates a massive temperature differential.

Under UAE tenancy law, specifically Dubai Law No. 26 of 2007 (as amended), the responsibility for structural maintenance and repairs that affect the habitability and health safety of the property falls upon the landlord. A mold infestation of this nature, stemming from potential underlying leaks or inadequate ventilation—a fundamental building system—is not considered minor tenant upkeep. You are responsible for general cleanliness, but the landlord is obligated to address issues that pose a health risk and are beyond surface cleaning.

Do not attempt to remove this yourself. Disturbing extensive black mold without proper containment, PPE, and HEPA filtration can aerosolize toxic spores throughout your apartment, creating a severe cross-contamination and health hazard. The musty odor is a clear indicator of active microbial volatile organic compounds (MVOCs).

You must formally notify your landlord in writing of the issue immediately, requesting professional remediation. For a proper resolution, we recommend a certified mold inspection to identify the full extent of the growth and the precise moisture source. Our team at Saniservice uses thermal imaging cameras and moisture meters for a non-invasive assessment, followed by a comprehensive remediation plan if required.
