Are tenants or landlords responsible for mold inspection?« Back to Previous Page

Our bedroom in our Jumeirah Village Circle apartment has had this persistent damp smell since the heavy humidity started a couple of months ago, and we’ve just found a patch of black spots spreading behind the wardrobe. My wife’s allergies have been terrible lately, and I’m worried it’s the cause. As tenants, are we responsible for getting a mold inspection ourselves, or is that something we need to get the landlord to arrange?

The responsibility for a mold inspection depends on the source of the moisture. Under UAE tenancy law, landlords are generally responsible for maintaining the structural integrity of the property. This includes fixing leaks from pipes, roofs, or windows that cause dampness. If the issue is due to a building defect, you must formally notify the landlord to arrange and pay for the inspection and subsequent remediation.
However, tenants are responsible for damage caused by their own actions, like failing to use the AC appropriately in our humid climate. Condensation from inadequate cooling is a frequent cause of mold in bedrooms and behind furniture. Given the visible growth and health symptoms in JVC, a professional inspection is strongly advised to identify the exact moisture source and mold type. This diagnostic report is crucial evidence. Document everything with photos and dates, then notify your landlord in writing about the issue and your wife's aggravated allergies. They are typically obligated to address the root cause if it’s structural. For your health's sake, do not attempt to clean significant growth yourself, as improper disturbance can spread spores. A proper inspection with lab analysis will determine the species and the necessary remediation steps. |
