Are tenants or landlords responsible for mold removal costs?« Back to Previous Page

We've lived in our Jumeirah Village Circle apartment for 2 years and just noticed a big patch of black mold behind the wardrobe in our master bedroom. It must have been growing slowly from a hidden AC leak. My husband’s asthma has been worse lately and I’m worried it’s the cause. As tenants, are we responsible for the mold removal costs or is this something our landlord has to fix?

In Dubai, responsibility for mold removal typically depends on the source of the moisture. Since the mold is from a hidden AC leak, this is likely a maintenance issue for the building's common system, making it the landlord's responsibility to repair the leak and address the resulting damage. Your responsibility as a tenant is generally to report the issue promptly and maintain good ventilation to prevent condensation.

Formally notify your landlord or property management company in writing about the mold and the suspected AC leak, including photos. Under Dubai's rental laws, landlords must provide habitable premises, which includes addressing issues that affect health and safety, like significant mold growth exacerbated by faulty fixtures. Your husband's worsened asthma is a serious health concern that strengthens the case for urgent remediation.

Do not attempt to remove a large patch yourself, especially with asthma in the household. Disturbing it can aerosolize spores and worsen air quality. A professional inspection is needed to assess the full extent behind the wardrobe and inside the wall cavity. The humid climate here means hidden moisture can cause rapid regrowth if not addressed completely.

The landlord should arrange for both the AC repair and proper mold remediation by a certified company. If they are unresponsive, you can escalate the matter to the Dubai Land Department or the Rental Dispute Center for resolution. Your tenancy contract may also have specific clauses regarding repairs and habitability; review it for any stated obligations.
