Are we or the landlord responsible for black mold cleanup?« Back to Previous Page

My kids have been coughing a lot and I suspect it's from the black mold that's been spreading along the corner of our master bedroom ceiling in our JVC villa. It started as a small patch after the heavy dew season a couple of months ago but is getting worse, even though we run the AC constantly. Are we responsible for the cleanup, or is this something the landlord has to fix?

Based on UAE tenancy law, specifically Law No. (26) of 2007, the responsibility for mold remediation depends on the root cause. The landlord is legally obligated to maintain the property's structural integrity. Therefore, if the black mold on your ceiling is a result of a structural issue, such as a leaking roof, faulty external waterproofing, or defective building envelope, the repair and subsequent mold cleanup are the landlord's responsibility.
However, tenant responsibilities include maintaining the property's interior and ensuring adequate ventilation. The Dubai climate, with its high humidity and constant AC use, creates significant condensation risks. If the mold growth is determined to be primarily due to lifestyle factors like insufficient ventilation, failing to regularly clean AC units, or indoor activities that generate excess moisture, the cost of remediation may fall to you. In your case, the location on the ceiling corner is a classic indicator of a condensation issue, often exacerbated by thermal bridging where the cool interior meets the warm exterior wall. While running the AC lowers temperature, it does not necessarily remove humidity effectively without proper settings and maintenance. Given the health symptoms you describe, we strongly recommend a professional inspection. Our certified inspectors can conduct a comprehensive assessment to identify the exact moisture source and type of mold, which is critical for determining liability and the correct remediation protocol. This technical report is essential for discussions with your landlord. Do not attempt to remove significant mold growth yourself, as improper handling can exacerbate spore dispersal and health risks.
