Are we responsible for AC leak and mold cleanup costs?« Back to Previous Page

The AC in our bedroom has been leaking a bit into the carpet for a couple of months, but now I’m finding black spots on the back of our wardrobe and my husband’s been having terrible allergies. We’re in an older building in Bur Dubai and I’ve told the landlord, but they just sent a handyman who wiped the wall and said it’s fine. Are we responsible for the health inspection and cleanup costs, or is it the building owner's job to properly fix this?

Under UAE tenancy law, the landlord is generally responsible for maintaining the main structure of the property, including the central air conditioning system and any leaks originating from it. Since the leak is from the AC unit itself, the landlord's obligation is to properly repair the leak at its source, not just wipe the visible mold. The handyman's action is a temporary measure that does not address the moisture problem.
The persistent humidity from the leak, combined with Dubai's climate, creates ideal conditions for mold growth inside walls and under carpets. The black spots on the wardrobe and your husband's allergies are strong indicators of a larger, hidden issue. Allergic reactions are a common health response to mold exposure. For your health and to formally document the issue, you should request a professional mold inspection. An inspection will identify the species and the full extent of the contamination, which is often not visible. This documented evidence is crucial. Send a formal written communication to the landlord, referencing the ongoing leak and health symptoms, and insist on a permanent fix of the AC unit and proper remediation of all resulting mold. If the landlord continues to be unresponsive, you can file a complaint with the Rental Dispute Settlement Center in Dubai, as a landlord's failure to address issues that affect health and habitability can be grounds for a formal dispute. |
