Are we responsible for AC leak causing mold?« Back to Previous Page

The AC in my apartment in Jumeirah Village Circle seems to be leaking a bit of water onto the carpet, and now I’m seeing these small black spots in the corner behind the bedroom wardrobe. My landlord is saying it’s due to how we use the AC, but we keep it at 24 degrees. Are we responsible for paying for a mold inspection, or is this the building management's issue to fix?

Black spots behind a wardrobe from an AC leak are almost certainly mold, and in most Dubai tenancy cases, the underlying leak is the landlord's responsibility to repair. Your AC usage at 24°C is reasonable and not the primary cause.

The core issue is the mechanical fault causing the water leak, which is a maintenance item for the property owner. The resulting mold growth is a direct consequence of that unrepaired leak. Landlords in Dubai are generally responsible for maintaining the property's structure and essential systems, including AC units and drainage, as per standard tenancy contracts.

Given Dubai's high humidity, mold can develop from a minor leak within 48-72 hours. A professional inspection is strongly advised to document the source of the leak, the extent of the mold, and the species present. This documentation is crucial for discussing responsibility with your landlord. For significant growth, a lab analysis can identify the mold type, which is important for assessing any required remediation steps.

Start by formally notifying your landlord or building management in writing about the leak and the emerging mold, including clear photos. Request immediate repair of the AC leak to prevent further damage. If they are unresponsive, you may need to reference your tenancy contract and escalate through Dubai's Rental Dispute Center (RDC). The cost of the inspection itself may be negotiable; some tenants choose to have it done to build their case, with the expectation that the landlord will later cover the cost as part of the repair obligation.
