Are we responsible for mold in our JVC apartment?« Back to Previous Page

We've been in our Jumeirah Village Circle apartment for about a year and just last week I pulled our sofa away from the wall to find a huge patch of black mold. It’s on the interior wall that backs up to the bathroom, and the plaster is actually damp to the touch. The landlord is saying it’s our fault for not ventilating properly, but we always use the exhaust fan. Are we legally responsible for the mold remediation and repair costs, or is this the landlord's duty to fix since it seems to be a hidden dampness issue within the wall?

Based on the description, this is highly likely a building envelope or plumbing issue, not a ventilation fault. The damp plaster on an interior wall adjacent to a bathroom strongly suggests a hidden leak from a pipe within the wall or a failure in the waterproofing membrane behind the bathroom tiles.

Under UAE tenancy law, specifically Law No. (26) of 2007, the landlord is responsible for maintaining the property's structure and ensuring it is habitable. This includes the integrity of plumbing systems, internal walls, and waterproofing. Since the mold growth is a result of a structural dampness issue you did not cause and could not reasonably prevent (even with proper use of the exhaust fan), the remediation and repair costs should not be your responsibility.

Your first step is to formally notify your landlord in writing about the issue, as they must be given a chance to rectify it. Given the potential health risks and structural damage, I strongly recommend you insist on a professional mold inspection. A certified inspector can perform moisture mapping and thermal imaging to pinpoint the exact source of the water intrusion. This technical report will serve as definitive evidence of the leak's origin, strengthening your position with the landlord.

For a situation this severe, with active dampness inside the wall, do not attempt remediation yourself. This requires professional containment and removal to prevent cross-contamination.

If the landlord remains uncooperative, you can escalate the matter to the Rental Dispute Center (RDC) in Dubai.
