Black mold behind sofa: landlord or tenant responsibility?« Back to Previous Page
|
We've lived here for 2 years and just noticed a bunch of black speckles growing along the bottom of the wall behind our sofa in the living room. It's an interior wall and the room is always cold because the AC vent is right there. We have a dehumidifier running most of the time, but it doesn't seem to be enough. Who is responsible for fixing this kind of thing, the building management or me as the tenant?

Based on the scenario you've described, this is a classic case of mold growth due to localized condensation, a common issue in Dubai's climate. The wall behind the sofa is a cold spot; the constant blast from the AC vent chills the wall surface, while the room's ambient humidity condenses on it. The sofa traps this moisture, creating a perfect microenvironment for mold, primarily the black speckles you see, which are likely Cladosporium or Stachybotrys.
Regarding responsibility under UAE tenancy law, the answer is nuanced. The landlord is generally responsible for the structural integrity of the property and for fixing issues arising from inherent building defects, such as leaking pipes inside the walls or faulty external waterproofing that causes moisture ingress. However, as a tenant, you are responsible for maintaining the property through adequate ventilation and humidity control to prevent issues stemming from daily living. Since you've identified the AC vent as the direct cause of the condensation, the responsibility could be argued to fall on you for not mitigating the conditioned air's effect. That said, a professional inspection is crucial to determine the exact moisture source and extent. I strongly recommend you cease DIY efforts and contact a certified mold inspector immediately. They will conduct hygro-thermal imaging to identify the precise dew point and moisture source and take air and surface samples to speciate the mold, which is critical for determining the appropriate remediation protocol and for any discussions with your landlord regarding liability.
