Is AC mold cleanup a tenant or landlord responsibility?« Back to Previous Page

The AC in my bedroom has been leaking a little for a couple of months, but last week I finally pulled the unit out and found a ton of black mold all over the wall behind it. Now my throat has been feeling scratchy in the mornings and I'm worried it's connected. As a tenant in Dubai Marina, am I responsible for paying to fix the AC unit and clean the mold, or is that the landlord's job since it's a maintenance issue?

In the UAE, particularly in high-humidity coastal areas like Dubai Marina, AC units are a prime source for mold growth due to condensation. The responsibility for remediation hinges on the nature of the issue. According to standard Dubai rental law (Law No. 26 of 2007), the landlord is responsible for the maintenance of the property's structural elements and central systems, which includes the fixed AC unit and the building envelope. The tenant is typically responsible for minor maintenance and any damage they cause.

The scenario you describe—a leaking AC unit leading to extensive mold growth on the wall—is a structural maintenance issue. The leak is the root cause, and the resulting mold is a direct consequence of that failure. Therefore, the financial responsibility for repairing the AC unit and the subsequent professional mold remediation of the wall falls to the landlord. You must notify them in writing immediately.

However, your health symptoms—a scratchy throat—are a significant concern and indicate exposure to mycotoxins and spores. This is not a minor issue. Do not attempt to clean this yourself, as improper handling will aerosolize the spores, worsening contamination and health risks. The wall likely requires professional assessment, containment, antimicrobial application, and possibly replacement of porous materials.

Given the health implications and the specific conditions of Dubai's climate, we strongly recommend a certified inspection to determine the full extent of the contamination.
