Is AC mold my fault or landlord's responsibility?« Back to Previous Page

The AC in my bedroom has been leaking a little for a couple of months, but now I've pulled back the corner of the carpet and found a huge patch of black mold underneath. My landlord is saying it's because I don't run the AC cold enough, but I keep it at 24. Is this my fault as the tenant or is it the landlord's responsibility to fix the leak and the mold?

Based on the scenario you've described, this is highly unlikely to be your fault and is almost certainly the landlord's responsibility. The core issue is a mechanical failure of the AC unit itself—a leak—which has created the persistent moisture necessary for mold growth.

Setting your AC to 24°C is a standard and reasonable temperature for the Dubai climate and is not the cause. The extreme humidity and constant AC operation in our region mean that any leak, no matter how small, will introduce significant moisture into building materials. This moisture, trapped underneath a carpet, creates a perfect incubator for mold. The landlord's argument is technically incorrect; the primary cause is the leak, not the thermostat setting.

Under typical UAE rental contracts (Law No. 26 of 2007) and the Dubai Rental Law, landlords are responsible for maintaining the property's structure and essential services, which includes the repair and maintenance of central air conditioning systems and the remediation of any damage they cause. A leaking AC unit falls squarely under this obligation.

However, you must act promptly. The "huge patch of black mold" indicates a significant infestation that requires professional assessment. Disturbing it can release harmful spores into your living environment.

I strongly recommend you immediately request a professional mold inspection from a certified company like Saniservice. Our experts can identify the exact mold species, determine the extent of the contamination, and provide a definitive report on the cause. This report is crucial evidence for formally requesting your landlord to perform the necessary AC repair and professional mold remediation, which must be handled by specialists to ensure it is removed safely and completely.
