Is black mold from AC leak landlord's responsibility in Dubai?« Back to Previous Page

The AC in my apartment seems to be leaking a bit of water onto the wall in my son's bedroom, and now I'm seeing a bunch of black, fuzzy spots spreading out from behind the headboard. We've lived here for 2 years and just noticed this over the last few weeks. Is this black mold, and as a tenant in Dubai Marina, am I responsible for the cleanup or is it my landlord's job since it might be from the AC unit?

Based on the description of black, fuzzy spots spreading from an AC leak in your son's bedroom, this is highly indicative of active mold growth, potentially including types like Stachybotrys chartarum (often referred to as "black mold") or Aspergillus niger. The persistent humidity and condensation from the AC leak create an ideal environment for such proliferation, a common issue in Dubai's climate where year-round AC use can lead to moisture problems if units are not properly maintained.

Under UAE tenancy law, specifically Dubai Law No. 26 of 2007 (as amended), the responsibility for major maintenance and structural repairs falls upon the landlord. Since the root cause is a malfunctioning or leaking AC unit—a fixture provided with the property—this is unequivocally the landlord's responsibility to rectify. This includes repairing the AC unit to stop the water intrusion and addressing the resultant mold damage. As the tenant, your obligation is typically limited to reporting the issue in a timely manner, which you have done.

However, for health and safety, immediate action is required. Do not attempt to clean significant mold growth yourself, as improper disturbance can aerosolize harmful spores. The situation requires professional assessment and remediation.

I strongly recommend you formally notify your landlord or property management company in writing immediately, detailing the issue and requesting urgent repairs and a professional mold inspection. For the inspection and safe remediation, you should engage a certified specialist. Our team at Saniservice is equipped to conduct comprehensive indoor air quality testing, identify the mold species, and execute a controlled remediation protocol to ensure the environment is safe for your family.
