Is black mold from AC leak tenant or landlord responsibility?« Back to Previous Page

The AC in my bedroom in our Deira apartment has been leaking a bit for a couple of months, and now I’ve found a patch of black, fuzzy mold spreading on the wall behind the headboard. We’ve had the AC unit serviced before, but the landlord says general maintenance is our problem. Is this black mold removal my responsibility as the tenant, or should the building owner handle it since it's related to the AC leak?

The responsibility typically lies with the landlord for structural issues and the tenant for general maintenance. In Dubai, an AC leak causing black mold is generally the landlord's responsibility to fix, as it involves the building's fixed systems. However, the tenant is usually responsible for the resulting mold cleanup if the leak was reported late.

You should immediately notify your landlord in writing about the AC leak and the mold growth, as this is a health and habitability issue under Dubai rental law. The landlord is obligated to provide a habitable premises and repair faults in permanent fixtures like the AC unit and internal piping. Document the leak and mold with photos and dated communications.

Given Dubai's high humidity, mold from an AC leak can spread quickly behind walls. This isn't a simple surface wipe; the wall cavity likely requires professional assessment to determine the extent of the damage. A certified mold inspection can identify the species and the source of moisture, which is critical for proper remediation.

For your health, relocate the bed and keep the area ventilated until resolved. While you may handle minor surface mold, an issue of this size linked to a long-term leak often requires professional remediation to prevent recurrence and address hidden growth, which a landlord might authorize.
