Is black mold from AC leak the landlord's responsibility?« Back to Previous Page

Our master bedroom AC unit in our Jumeirah apartment has been leaking a bit for the last couple of months, and now I've spotted patches of black, fuzzy mold starting to spread on the wall behind the curtain. We've had a lot of humidity lately and it's getting worse. Is fixing this the responsibility of my landlord, or do I have to handle the cleanup and repairs myself?

Based on UAE tenancy law, specifically Law No. (26) of 2007, the landlord is generally responsible for the maintenance of the property's main structural components and essential services, which includes the central air conditioning system and the building envelope (walls, ceilings). Since the mold growth is a direct result of a malfunctioning AC unit that has been leaking for months, the remediation of the mold and the repair of the AC are likely the legal responsibility of your landlord. You must formally notify them in writing of the issue to initiate the repair process.

The black, fuzzy growth you describe is a significant concern. In Dubai's high-humidity climate, AC units are critical for controlling moisture and preventing mold. A leaking unit creates a constant source of dampness, and Stachybotrys chartarum (black mold) thrives in such cellulose-rich, wet environments like drywall. This is not a simple cleaning task; improper disturbance can aerosolize harmful mycotoxins.

We strongly recommend a professional inspection. Our certified experts can conduct a comprehensive assessment, including moisture mapping and air quality testing, to determine the full extent of the contamination hidden within the wall cavity. This provides a factual report you can present to your landlord, outlining the necessary scope of remediation work.
