Is black mold in my apartment the landlord's responsibility?« Back to Previous Page

We’ve been in our Marina apartment for two years and just noticed a patch of black mold spreading from the corner of our bedroom closet, behind our clothes. The AC unit’s drip pan is right on the other side of that wall. Is fixing this leak and cleaning the mold the landlord's responsibility, or is this on me as the tenant to handle?

Based on your description, this is a classic case of condensation-related mold growth, extremely common in Dubai due to the high humidity and constant AC operation. The location directly adjacent to the AC drip pan is a significant clue.

Under UAE tenancy law, specifically Law No. (26) of 2007, the landlord is responsible for maintaining the structural integrity of the property and the functionality of its core systems, which includes the central AC system and its components like the drip pan and drainage lines. A leaking drip pan is a maintenance issue for the property owner to rectify. Therefore, the source of the moisture—the leak—is unequivocally the landlord's responsibility to repair.

However, the resulting mold growth on your personal belongings and the surface cleaning may fall to you as the tenant, as it is considered a consequence of the environment. That said, a professional must assess the extent. Surface mold is one issue, but if the moisture has penetrated the drywall or structure, it becomes a much more serious remediation project that the landlord must address.

Do not attempt to clean this yourself. Disturbing black mold without proper containment can aerosolize spores and contaminate your entire apartment. The leak must be fixed first, or the mold will return immediately.

We strongly recommend a professional inspection to determine the full extent of the moisture damage, identify the mold species, and create a protocol for safe remediation. Our certified inspectors at Saniservice use thermal imaging and moisture meters to pinpoint the exact source and scope of the problem, providing a formal report that can be used to liaise with your landlord.
