Is black mold in my rental apartment my responsibility?« Back to Previous Page

We've lived in our Jumeirah Village apartment for 2 years and just noticed a patch of black mold in the corner of our bedroom closet where our winter clothes are stored. It’s been extra humid lately and I’m worried it’s spreading. Is it my responsibility as a tenant to clean and treat this, or should I be contacting my landlord to handle the mold prevention?

Based on UAE tenancy law, specifically Law No. 26 of 2007, the responsibility for mold largely depends on the source of the moisture. As a tenant, you are responsible for maintaining the property's cleanliness and ensuring adequate ventilation to prevent issues like condensation, which is a major culprit in our humid climate. This often includes cleaning and maintaining the interior of closets and ensuring AC units are used to control humidity.

However, if the mold is a result of a structural issue, such as a leaking pipe within the wall, a faulty AC drainage line, or water seepage from the building's exterior, this falls under the landlord's obligation to maintain the property's structural integrity.

Given that you've noticed it in a closet with stored clothes, it's likely exacerbated by restricted airflow and humidity. Your first step should be to thoroughly clean the affected area with a specialized mold removal solution (never just bleach, as it doesn't kill the roots). Immediately improve ventilation in that area and consider using a dehumidifier or ensuring your AC is running consistently to keep humidity levels below 60%.

For a definitive answer on liability and to ensure it's properly handled, I strongly recommend a professional inspection. We can identify the exact moisture source and species of mold, which dictates the remediation protocol. This documented report is also crucial if you need to formally request your landlord to address an underlying structural cause.
