Is black mold in my rental the landlord's responsibility?« Back to Previous Page

We've lived here for 2 years and just noticed black spots forming along the bottom edge of the wall behind our sofa in the living room. I think it started after the heavy humidity last month but we only just moved the furniture. The wall feels slightly damp to the touch. Is this dangerous black mold and who is responsible for fixing it in a rented villa in Al Barsha, me or the landlord?

Based on the description of your situation in Al Barsha, you are very likely dealing with a mold infestation caused by excess moisture. The black spots and damp feeling on the wall are classic indicators. In Dubai's climate, high external humidity, especially during the summer months, can lead to significant condensation on cooler internal surfaces, particularly on exterior walls behind large furniture that restricts airflow, like your sofa. This creates the perfect damp, dark environment for mold, such as the notorious Stachybotrys chartarum (often called "black mold"), to proliferate.

Under UAE rental law, specifically Law No. (26) of 2007, the responsibility for maintenance falls on the landlord if the issue is structural in nature. This includes problems with the building's external waterproofing, leaking central AC systems, or inherent construction defects that allow moisture ingress. As a tenant, you are typically responsible for maintenance resulting from your own use, such as ensuring adequate ventilation and not blocking AC vents.

Given the wall is damp to the touch, this strongly suggests a persistent moisture source. Your first step is to formally notify your landlord or property management company in writing, with photos, and request an immediate inspection to determine the source of the moisture. Do not attempt to clean significant mold growth yourself, as improper handling can aerosolize harmful spores.

For a definitive diagnosis of the mold type and to identify the exact moisture source, a professional inspection is essential. We at Saniservice specialize in such assessments using tools like thermal imaging and moisture meters. We can provide a detailed report that clarifies responsibility and outlines the required remediation protocol.
