Is black mold in our rental apartment the landlord's responsibility?« Back to Previous Page

We've lived in our Jumeirah Village Circle apartment for two years, and just noticed a big patch of black mold spreading from the corner of our bedroom ceiling, right behind the wardrobe. It's gotten much worse since the heavy dew last week, and the room constantly smells damp. Are we responsible for cleaning this, or is this the landlord's job to fix since it seems like a building issue?

Based on the specifics you've provided—a large patch of black mold spreading from the ceiling corner, exacerbated by recent high humidity, and a persistent damp smell—this is highly indicative of a structural or building envelope issue. In the UAE, the responsibility for such repairs is typically dictated by the rental contract and Law No. 26 of 2007, as amended. The landlord is generally responsible for maintaining the property's structural integrity, including the external walls and roof, and for fixing any defects that affect the tenant's enjoyment of the property, such as water seepage leading to mold.

The climate in Dubai, with its high humidity and constant air conditioning use, creates significant condensation risks. The location behind the wardrobe is a classic sign of a cold bridge or a leak from the building's exterior, where warm, humid air is condensing on a cold surface within the wall or ceiling void. This is not a simple surface cleanliness issue.

For a case of this severity, a professional inspection is absolutely critical. DIY cleaning is not advised, as improper handling can aerosolize toxic spores. A certified inspector will conduct moisture mapping and air quality testing to identify the exact moisture source (e.g., leaking AC drain line, capillary seepage, or a crack in the building facade) and determine the full extent of the contamination. This official report is also essential evidence should you need to formally request remediation from your landlord.
