Is black mold in rental landlord's responsibility?« Back to Previous Page

My kids have been coughing and I suspect it's from the black mold that's been spreading in the closet of our master bedroom in our Jumeirah Village apartment. It started appearing on the back wall after the heavy humidity a couple of months ago. We’ve wiped it down, but it just keeps coming back worse.
Are we responsible for cleaning this or is it the landlord's duty to fix the underlying issue?

Based on the Dubai Rental Law (Law No. 26 of 2007), the responsibility for maintenance is divided between the tenant and landlord. Structural issues and defects in the main building components that are not caused by the tenant's misuse are the legal responsibility of the landlord.
The black mold recurrence in your closet is a classic symptom of a persistent underlying moisture issue, likely stemming from a hidden plumbing leak within the wall or, more commonly in Jumeirah Village apartments, inadequate insulation leading to thermal bridging and condensation. The high humidity we experience, combined with year-round AC use, creates massive condensation problems if the building envelope is compromised. Simply wiping the visible mold is a temporary measure; the hidden fungal roots (hyphae) remain and will continue to release spores, which are the likely irritant causing your children's coughing. Your responsibility as a tenant is to report this issue in writing to the landlord or property management company immediately. Provide clear photographs and details. They are then obligated to address the source of the moisture intrusion. If they fail to act, you can file a formal complaint with the Rental Dispute Center (RDC) in Dubai. However, for health and legal documentation, a professional inspection is critical. Our certified mold assessors at Saniservice can conduct a comprehensive investigation using moisture meters, thermal imaging cameras, and air/surface sampling to definitively identify the moisture source and the species of mold present. This provides an official report that can be used to compel your landlord to act and confirms the scope of necessary remediation.
