Is black mold near AC vent landlord's responsibility?« Back to Previous Page

We've lived in our Jumeirah apartment for 2 years and just noticed a patch of black, fuzzy mold spreading from the corner of our bedroom ceiling, right near the AC vent. It's gotten much worse since the humidity spiked last month. I'm worried about my family's health, but I'm not sure if this is something I should fix myself or if it's my landlord's responsibility to handle and pay for.

Under Dubai rental law (Law No. 26 of 2007), structural repairs and issues related to the building's integrity are the landlord's responsibility. This typically includes fixing leaks in the central AC system, repairing roof or wall seepage, and remediating mold caused by such structural defects. Since the mold is spreading from the ceiling near the AC vent, the source is likely condensation within the ductwork or a leak from the apartment above—both are structural issues the landlord must address.
You should formally notify your landlord in writing about the problem immediately. Include clear photos showing the mold's location and progression. They are obligated to investigate and fix the root cause to prevent it from returning. However, if the mold growth was caused by your own actions, like severely blocking ventilation, the responsibility might shift. Given the black mold's appearance and its location at the vent, a professional inspection is strongly advised before any cleanup is attempted. Disturbing it can release spores throughout your apartment. An inspection can identify the exact species and the moisture source, which is critical evidence for your landlord. In Dubai's climate, with high humidity and year-round AC use, condensation in poorly insulated ducts is a common, recurring problem that needs a proper fix, not just a surface clean. |
