Is black mold removal the tenant or landlord's responsibility« Back to Previous Page

We've lived in our Jumeirah Village Triangle apartment for 2 years and just noticed a huge patch of black mold spreading behind the wardrobe in the master bedroom. It must have been growing slowly for ages, but it's really visible now after all the recent humidity. I'm worried about our health and the damage to the walls. Is getting this professionally removed the responsibility of me as the tenant or my landlord?

Under Dubai rental law, the landlord is typically responsible for structural repairs and issues arising from the building's condition, which includes water leaks and moisture penetration that lead to mold growth. As a tenant, you are responsible for reporting the issue promptly and for maintaining the property through adequate ventilation to prevent condensation.

Given the location behind a wardrobe, this strongly suggests a hidden leak from plumbing or a crack in the wall, or severe condensation due to lack of air circulation. The recent high humidity has accelerated its growth. Your first step is to formally notify your landlord or property management company in writing, with clear photos. They are obligated to investigate and address the source of the moisture.

Do not attempt to remove it yourself. Disturbing a large patch of black mold can release a high concentration of spores, potentially affecting your health. A professional inspection is needed to identify the exact moisture source and the mold species. Remediation involves fixing the water issue first, then safely containing and removing the contaminated materials. In Jumeirah Village Triangle, where many buildings are relatively new, this is a common issue often traced to AC condensation drain leaks or minor structural settling.

If the landlord disputes responsibility, you can file a case with the Rental Dispute Center (RDC) in Dubai. They will assess whether the cause is structural (landlord's duty) or due to tenant negligence, like failing to use the AC to control humidity. For a case this visible, documentation from an independent mold assessment can be critical evidence.
