Is black mold removal the tenant's or landlord's responsibility?« Back to Previous Page

We've lived in our Jumeirah apartment for 2 years and just noticed a large patch of black mold behind the wardrobe in our master bedroom. It must have been there a while, hidden from view, and the wall feels damp to the touch. I’m worried about our health and the damage. Is getting this removed the responsibility of me as the tenant, or is my landlord required to handle and pay for it?

In the UAE, landlord-tenant responsibility for mold remediation is typically governed by the rental contract and Law No. 26 of 2007, amended by Law No. 33 of 2008. The general principle is that the landlord is responsible for the structural integrity of the property, including issues arising from inherent building defects, faulty construction, or failing infrastructure like leaking central AC chillers or pipework within the walls. As a tenant, you are responsible for maintaining the property and reporting issues promptly, as well as for damage caused by your own negligence or failure to adequately ventilate the space.

Your situation in Jumeirah is critical. A large, damp patch of black mold (Stachybotrys chartarum) hidden behind furniture is a severe health and property hazard. The dampness suggests an active moisture source, which must be identified. Given Dubai's high humidity and the constant use of AC, condensation within wall cavities due to poor insulation or a hidden plumbing leak from an adjacent bathroom or AC unit are common culprits. This is not a simple surface condensation issue from daily living.

I strongly recommend you immediately notify your landlord in writing, with photos, as this likely stems from a structural defect. Do not attempt removal yourself, as disturbing black mold releases harmful mycotoxins. A professional inspection is essential to diagnose the exact moisture source and extent of contamination. We use thermal imaging cameras and moisture meters to pinpoint the origin without destructive investigation.
