Is black mold repair the landlord's responsibility?« Back to Previous Page

My kids have been coughing and I suspect it's from the black mold that's spreading on the bathroom ceiling near the AC vent. We've been in this Jumeirah Village Circle apartment for over a year but this just started getting really bad since the weather got more humid. I’ve tried cleaning it with bleach but it just comes back worse.
Is this kind of repair the landlord's responsibility, or do I have to handle it myself?

Based on the UAE Civil Code, specifically Federal Law No. 5 of 1985, the responsibility for structural repairs and maintenance of the property's core systems falls upon the landlord. This includes issues arising from inherent building defects, such as faulty ventilation systems or inadequate waterproofing that lead to persistent dampness and mold growth. Since the mold is concentrated near the AC vent, the root cause is likely a combination of condensation from the AC unit and potential leakage or insufficient insulation in the ductwork, which are the landlord's responsibility to rectify.
However, it is critical to address this immediately. The recurring black mold, especially after a bleach treatment which only superficially bleaches the surface and can exacerbate the problem by adding moisture, indicates a deep-seated issue. Your children's coughing is a significant health red flag, as Stachybotrys chartarum (black mold) produces mycotoxins that can cause respiratory distress. The high humidity of the Dubai climate, particularly during summer months, creates a perfect environment for such rapid mold proliferation. We strongly recommend you cease any DIY cleaning attempts and contact your landlord with a formal written request for a professional mold inspection and remediation. For your family's health and to properly document the issue for your landlord, consider engaging a certified environmental inspector. Our team at Saniservice can conduct a comprehensive assessment, including air quality and surface sampling, to identify the exact species and root cause. This detailed report will serve as crucial evidence for your landlord and outlines the precise remediation protocol required to resolve the issue permanently.
