Is black mold the landlord's responsibility?« Back to Previous Page

We've lived in our Deira apartment for 2 years and just noticed a big patch of black mold in the corner of our master bedroom closet. It must have been growing slowly behind the shelves. The humidity has been brutal lately and I’m worried it’s a bigger issue. Is fixing this the landlord's responsibility or do I have to handle it myself?

In the UAE, the responsibility for mold remediation in a rental property is typically governed by the terms of your tenancy contract and Dubai Law No. 26 of 2007, as amended (the 'Dubai Rental Law'). Generally, the landlord is responsible for the structural integrity of the property and addressing issues arising from inherent building defects, such as leaking pipes within the walls or faulty external waterproofing that leads to moisture ingress.

Your situation in Deira, with black mold developing in a closet, is a common consequence of the extreme humidity we experience, especially when combined with condensation from year-round AC use and poor ventilation. If the mold is a direct result of a structural defect (e.g., a hidden water leak from an adjacent bathroom or the building envelope), the financial responsibility for the investigation and remediation falls squarely on the landlord. You must notify them in writing immediately.

However, if the investigation determines the cause is primarily tenant-related—such as insufficient use of AC for dehumidification, blocking AC vents, or poor air circulation within the closet—you may be liable for the cost of remediation.

Given the presence of a significant patch of black mold (Stachybotrys chartarum), a professional inspection is absolutely critical. We do not recommend DIY attempts, as improper handling can aerosolize toxic spores throughout your apartment. A certified inspector will conduct moisture mapping and air quality testing to identify the precise moisture source and extent of contamination. This technical report is essential evidence to determine liability and scope the required remediation, which involves containment, professional-grade antimicrobial application, and HEPA vacuuming.
