Is dampness and mildew my landlord's responsibility?« Back to Previous Page

After the rain last month, I noticed a musty smell lingering in my bedroom closet. The walls seem damp despite turning on the dehumidifier. We’ve lived here for 2 years and just noticed some mildew spots starting to form. Is this something that should be addressed by me or is it the landlord’s responsibility?

In the context of the UAE and specifically Dubai, the responsibility for addressing dampness and mildew can be somewhat nuanced. It generally depends on the terms outlined within your lease agreement as well as local laws that may apply.

According to the Real Estate Agency Law in the UAE (Federal Decree-Law No. 15 of 1974), landlords are responsible for maintaining the property in a habitable condition, which includes ensuring there is no structural damage or issues such as water leaks and dampness that can lead to mold growth.

However, under the same law, tenants also have responsibilities, including keeping the premises clean and reporting any defects or issues promptly. This means you should inform your landlord about the musty smell and visible mildew spots in your bedroom closet.

Given the circumstances described—damp walls despite using a dehumidifier, combined with the onset of mold—the situation does warrant professional attention. Mold can pose health risks, particularly to individuals sensitive to allergens, making it crucial not to delay addressing this issue.

I would recommend scheduling an inspection by a certified environmental expert who specializes in mold evaluation and remediation within the UAE/Dubai region. This is not just about ensuring compliance with local regulations but also safeguarding your and your family's health. A professional can provide a detailed assessment of the extent of the problem, recommend appropriate remediation methods, and ensure that all necessary steps are taken to prevent future occurrences.

In the meantime, it would be wise to take some preliminary measures such as improving ventilation in the affected area and addressing any potential sources of moisture. However, these actions should complement, not replace, a professional assessment and intervention.
