Is landlord or tenant responsible for AC mold smell?« Back to Previous Page

The AC in my apartment seems to be blowing out a really damp, moldy smell that's starting to cling to the walls in our second bedroom. We've lived here for 2 years in Silicon Oasis and it's never been this bad, especially since the humidity kicked in a few weeks ago. I've wiped down the visible black spots near the vent, but the smell comes right back. Who is legally responsible for getting this professionally cleaned and treated, me as the tenant or my landlord?

Based on UAE tenancy law, specifically Law No. 26 of 2007 and its amendments, the responsibility for rectifying this issue is highly likely to fall upon your landlord. The law mandates that the landlord is responsible for maintaining the property in a habitable condition, which includes the maintenance and repair of major installations like the central air conditioning system. The AC unit is considered a fundamental part of the property's infrastructure.

The damp, clinging smell and recurring visible growth you describe are classic indicators of a significant microbial contamination within the AC system itself, specifically in the evaporator coils and drip pans. This is an extremely common issue in Dubai due to our high ambient humidity and the year-round reliance on AC. The units constantly remove moisture from the air; if the condensate drain line is clogged or the internal components are not professionally cleaned and treated, it creates a perfect breeding ground for mold and bacteria. Surface wiping is a temporary measure, as the contamination source is deep within the ductwork and mechanical system.

Your first step should be to formally notify your landlord or property management company in writing, detailing the issue and requesting immediate professional inspection and remediation. This creates a necessary paper trail. Given the systemic nature of the problem and the health implications of airborne spores, a professional assessment is non-negotiable.

For a definitive diagnosis and a legally valid report that you can present to your landlord, I strongly recommend a certified mold inspection. Our team at Saniservice specializes in using borescopes to inspect internal AC components and air quality testing to identify spore types and concentration levels. This technical report will clearly define the scope of work required for remediation.

Do not delay, as this problem will only worsen. For immediate assistance, please call our experts at 800-MOLDS (800-66537) or email hello@saniservice.com to schedule an inspection.
