Is landlord or tenant responsible for mold inspection?« Back to Previous Page

Our master bedroom closet on the outer wall has felt damp for the last month, and I just pulled out a winter jacket to find several dark greenish spots on it and the wall behind. We’re in an older building in Deira and the AC runs constantly, but it doesn't seem to help. Who is responsible for getting a proper mold inspection done here, me as the tenant or the landlord, and what’s the first step I should take?

In the UAE, specifically under Dubai's rental law (Law No. 26 of 2007), the responsibility for maintenance of the property's core structure, including issues arising from inherent building defects like leaks in external walls or faulty AC systems, falls upon the landlord. As a tenant, you are responsible for minor internal maintenance, but the scenario you describe—dampness on an outer wall leading to mold growth—typically indicates a structural or systemic issue. The first step is to formally notify your landlord or property management company in writing, detailing the issue with photographs as evidence. This creates a legal paper trail.

Given Dubai's high humidity levels and constant AC operation, which can create significant condensation if units are undersized or not draining properly, a professional inspection is critical. DIY assessments are insufficient as they fail to identify the root moisture source (e.g., capillary rise through the concrete, a leaking pipe within the wall, or negative air pressure) and the specific mold species, some of which can be hazardous.

We strongly recommend engaging a certified mold inspection company like Saniservice. Our experts conduct a comprehensive assessment using moisture meters, thermal imaging cameras, and air quality sampling to pinpoint the exact cause and extent of contamination, providing a definitive report for the landlord. This evidence-based approach is essential for ensuring the landlord addresses the remediation properly.
