Is landlord responsible for AC-caused mold remediation?« Back to Previous Page

The wall behind the wardrobe in our master bedroom has a huge patch of black mold that we just discovered. We’ve been in this Discovery Gardens studio for about a year, and the AC condensation seems to constantly make that wall damp. I'm really worried about our health. Is the landlord responsible for the remediation costs, or is this something I have to handle and pay for myself as the tenant?

Typically, the landlord is responsible for remedying structural issues like a leaking AC condensation line that causes damp walls and mold, as this falls under maintaining the property's habitability. In Dubai, tenancy law generally holds the landlord accountable for repairs related to the building's core structure and fixed systems, including the AC.

Your first step is to formally notify the landlord or property management company in writing, with photos, detailing the issue. They are obligated to address the source of the moisture—likely a blocked or faulty condensate drain line common in Dubai's climate. However, if the damage was caused by tenant negligence, such as not using the AC and allowing humidity to build up, the responsibility could shift.

Given the size of the patch, a professional inspection is strongly advised to identify the exact mold species and the full extent of the problem behind the wall. Remediation involves fixing the water source, properly removing the contaminated materials, and treating the area to prevent recurrence. For verifiable results, ensure any remediation company provides before-and-after lab testing data.
