Is landlord responsible for AC leak and mold?« Back to Previous Page

The AC in my apartment seems to be leaking a bit of water onto the carpet in the master bedroom, and now we’ve got a large black mold patch spreading behind the wardrobe. I’ve tried wiping it but the smell is awful and it just comes back. We’ve been in this Jumeirah Village Circle apartment for almost a year with no issues until now. Is the landlord responsible for fixing the AC and the mold remediation, or is cleaning it up on me?

Based on the UAE Civil Code, specifically Federal Law No. 5 of 1985, the landlord is legally obligated to maintain the property in a habitable condition. This includes the maintenance and repair of all essential fixtures, such as the air conditioning system. The AC leak is the direct cause of the moisture intrusion, which has resulted in the mold growth. Therefore, the responsibility for repairing the AC unit and the subsequent mold remediation lies squarely with your landlord.
The situation you describe in your JVC apartment is a serious environmental concern. The black mold patch and persistent musty odor indicate a significant and active colony. Wiping it is ineffective as it only removes the surface spores; the mycotoxins and root system (hyphae) remain deep within the building materials. The high humidity and constant use of AC in Dubai's climate creates a perfect environment for such rapid colonization, especially when a water source like a leak is present. I strongly advise you to immediately notify your landlord in writing about both the AC malfunction and the resulting mold contamination, requesting urgent professional remediation. For a case of this severity, a professional inspection is non-negotiable. Our certified team at Saniservice uses thermal imaging to pinpoint the exact moisture source and air sampling to identify the spore types and concentration levels. This data is critical for executing a proper remediation protocol, which involves containment, HEPA filtration, antimicrobial treatment, and removal of affected porous materials like the carpet and drywall. Do not delay. For immediate assistance with inspection and a formal report for your landlord, please call us at 800-MOLDS or email hello@saniservice.com. |
