Is landlord responsible for AC leak and mold in rental?« Back to Previous Page

The AC in my apartment seems to be leaking a little, and now there's a growing patch of black mold on the bedroom wall behind the wardrobe. I've wiped it down twice but it keeps coming back worse, and my husband has started getting headaches. We've been in this Jumeirah Village Circle villa for about a year—is getting this properly treated our responsibility as tenants, or is this something the landlord needs to fix?

Based on the Dubai Rental Law (Law No. 26 of 2007), the landlord is generally responsible for all major maintenance and repairs related to the structure of the property and its core systems, which includes the air conditioning system. An AC leak is considered a structural issue that the landlord must rectify, as it is the root cause of your mold problem. The persistent moisture from the leak, combined with Dubai's high ambient humidity and the constant cooling cycle creating condensation, provides the perfect environment for toxic black mold (likely Stachybotrys chartarum) to thrive.

Simply wiping the visible growth is ineffective, as the mycotoxins and hyphae penetrate deep into the porous wall material. This is a serious health concern, as evidenced by your husband's headaches, and requires professional remediation. As a tenant, your responsibility is to report the issue in writing to the landlord or property management company immediately, giving them a reasonable timeframe to address it. If they are unresponsive, you can file a formal complaint with the Rental Dispute Center (RDC) in Dubai.

For your safety, I strongly recommend a professional inspection and remediation. Our certified team at Saniservice uses thermal imaging to locate the exact source of moisture, conducts air and surface sampling to identify the mold species and spore count, and performs a full containment and hygienization process to safely remove the contaminated materials and eradicate the colony at its source.
