Is landlord responsible for AC leak and mold remediation?« Back to Previous Page

The AC in our bedroom has been leaking a bit for a couple of months, and now we're seeing black, fuzzy patches spreading on the wall behind the wardrobe. We’ve been renting this apartment in Jumeirah Village Circle for over a year and our last maintenance request took forever for the landlord to address. Who is legally responsible for dealing with this – is it on me to clean it or is my landlord required to handle the remediation?

Based on the UAE Civil Code, specifically Federal Law No. 5 of 1985, the landlord is legally obligated to maintain the property in a habitable condition. This includes addressing structural issues and faults within the building's systems, such as a leaking AC unit, which is the direct cause of your mold problem. The persistent leak has created the chronic moisture condition necessary for Stachybotrys chartarum (black mold) to proliferate.

The humid climate of Dubai, combined with year-round AC use, creates a high-risk environment for condensation and microbial growth if systems are not properly maintained. The fuzzy, spreading patches you describe indicate an active and significant infestation, likely within the wall cavity behind the wardrobe. DIY cleaning is strongly discouraged for black mold, as improper remediation can aerosolize toxic mycotoxins, posing serious health risks and causing the infestation to spread further.

Your responsibility as a tenant is to report the issue in writing to the landlord or property management company immediately, which you have done. Document the damage thoroughly with photographs and follow up persistently. Given the health implications and potential for structural damage, this constitutes an urgent maintenance issue.

For a definitive assessment and to ensure the remediation is handled correctly and safely, I recommend a professional inspection. Our certified team at Saniservice can provide a comprehensive assessment, including moisture mapping and air quality testing, to determine the full extent of the contamination and provide a formal report that can be used to compel your landlord to act.
