Is landlord responsible for AC leak mold in Dubai?« Back to Previous Page

The AC in my apartment in Jumeirah seems to be leaking water onto the wall, and now a big black mold patch has spread behind the bedroom wardrobe. My landlord is saying it's because we don't run the AC cold enough, but we keep it at 23 degrees. Who is legally responsible for the mold remediation and fixing the AC unit in this case?

Based on UAE tenancy law, specifically Law No. (26) of 2007 and its amendments, the landlord is generally responsible for the maintenance of the property's structural elements and major installations, which includes the central air conditioning system and the building envelope. The AC leak causing water damage and subsequent mold growth falls squarely under this category of major maintenance.

The landlord's claim that setting the AC to 23°C is the cause is technically unfounded. While Dubai's extreme humidity can lead to condensation issues if an AC is significantly underpowered or set at a very high temperature, 23°C is a standard and reasonable setting. The primary cause is almost certainly a malfunction within the AC unit itself, such as a blocked condensate drain line, a damaged drain pan, or improper installation and insulation of the ductwork. This failure of the appliance has led to moisture intrusion, creating the perfect environment for mold, which is a known health hazard.

Your immediate steps should be to formally notify your landlord in writing (email is best for a paper trail) of the issue, including photographs of the leak and the mold growth. Clearly state that the mold is a result of the faulty AC unit, which is their responsibility to repair. Under the law, they are obligated to address this promptly.

For a case of this severity, with a "big black mold patch," a professional inspection is critical. Our certified team at Saniservice can provide a comprehensive assessment to identify the exact species of mold, the extent of the contamination behind the wardrobe, and the precise source of the moisture. This professional report will serve as vital evidence for your landlord and, if necessary, for the Dubai Rental Dispute Center. Do not attempt to remove it yourself, as disturbing large mold colonies can aerosolize spores and exacerbate the problem.
