Is landlord responsible for AC mold and wall damage?« Back to Previous Page

The AC in my bedroom has been making a weird damp smell for a couple of months, and now I’ve found black spots spreading along the wall behind my wardrobe. We’re coming into the humid summer now and it’s getting worse. Is my landlord responsible for fixing the mold and the leaking AC unit, or is this on me to handle?

Based on your description of a damp smell from the AC followed by visible black mold growth on the wall, you are almost certainly dealing with a microbial issue caused by excess moisture. The pattern you describe—growth behind furniture like a wardrobe—is a classic sign of condensation buildup due to poor air circulation, exacerbated by the high humidity levels we experience in Dubai, especially during summer.

In the UAE, the responsibility for such repairs is typically dictated by your tenancy contract and Law No. (26) of 2007, known as the Dubai Rental Law. Generally, the landlord is responsible for the maintenance of the main structure of the property, including the central AC system and any structural issues that lead to water leakage or infiltration. If the mold is a direct result of a malfunctioning or leaking AC unit, which is considered a fundamental provision of the property, the landlord is obligated to address the repair of the unit and the resultant damage. However, if the moisture is solely due to tenant behavior (e.g., lack of ventilation), the responsibility may shift.

Crucially, the spreading black spots indicate an active colony. Disturbing it without proper containment can aerosolize spores and spread the contamination. A professional inspection is essential to identify the exact moisture source (e.g., clogged condensate drain, faulty insulation, leaking pipe) and assess the full extent of the mold growth, which is often more widespread than what is visible.

I strongly recommend you contact your landlord immediately with your findings and request a professional mold inspection and remediation.
