Is landlord responsible for AC mold in JVC rental?« Back to Previous Page

The AC in my bedroom has been leaking a bit for a couple of months, but now I’ve found a patch of black mold on the wall behind the headboard. I’ve been wiping the condensation away, but it’s getting worse, especially with the humidity. As a tenant in Jumeirah Village Circle, am I responsible for fixing the AC unit that’s causing this, or is the landlord required to handle the mold remediation?

Under Dubai's rental law, the landlord is generally responsible for maintaining the structural integrity of the property and its major systems, including the AC unit that is part of the building. Since the mold is a direct result of a leaking AC, the repair of the unit itself is the landlord's obligation.

You are responsible for reporting the issue in writing to the landlord or property manager immediately. Keep a record of all communication. For the mold remediation, the responsibility can depend on the tenancy contract, but the root cause (the AC leak) must be addressed by the landlord first. Simply wiping the visible mold is insufficient; the moisture source must be eliminated.

Given JVC's high humidity and the mold's location behind furniture, professional assessment is strongly advised. Hidden mold within the wall or AC ducting is likely. A proper inspection can determine the full extent of contamination and create a scope of work for the landlord to address. Until the leak is fixed and the area is professionally dried, the mold will continue to return.
