Is landlord responsible for AC mold in my Deira apartment?« Back to Previous Page

The AC in my apartment seems to be constantly damp around the vents in the living room, and we’ve started finding black spots on the back of our sofa that’s against the exterior wall in our Deira flat. It’s been getting worse since the humidity really kicked in a couple of months ago. Who is responsible for dealing with this, me as the tenant or is my landlord supposed to arrange and pay for the inspection and cleanup?

Under Dubai Law No. 26 of 2007 (Amended by Law No. 33 of 2008), your landlord is responsible for maintaining the property's main systems, including the central air conditioning. This typically covers the AC unit itself, the ductwork, and any issues arising from its function, like condensation leaks or mold growth inside the system that is affecting the property.

The dampness around your vents and the black spots on the exterior wall sofa are classic signs of a condensation issue, which is very common in Deira's high humidity. The problem likely stems from poorly insulated ductwork or a blocked condensate drain line causing moisture to leak into your living space. This moisture, combined with organic material like dust, creates an ideal environment for mold.

Your first step is to formally notify your landlord or property management company in writing, detailing the issue and including clear photographs. They are generally obligated to arrange and pay for the inspection and remediation of the mold if it originates from the building's AC system or structural issues. However, if the mold is conclusively due to tenant negligence (e.g., blocking vents, not reporting a leak immediately), the cost could fall to you.

Given the visible growth, a professional inspection is strongly advised to identify the moisture source and mold type. A proper assessment from a company with microbiological lab testing can provide the evidence needed to clarify responsibility and ensure the remediation addresses the root cause, not just the visible spots.
