Is landlord responsible for AC-related mold in apartment?« Back to Previous Page

We've lived in our Jumeirah Village Circle apartment for 2 years and just noticed a huge patch of black mold spreading from behind our bedroom wardrobe. It must have been growing slowly for ages. The AC unit is right on the other side of that wall and it's always damp there. Are we responsible for cleaning this and paying for any damage, or is this something our landlord has to fix since it's related to the building's AC system?

The responsibility depends on the source of the moisture. Under Dubai rental law (Law No. 26 of 2007), landlords are responsible for maintaining the structural integrity of the property and its major systems, including the central AC. If the mold is a direct result of a fault in the AC unit itself—like a leaking condensation drain line or a faulty insulated duct within the wall—the repair and remediation cost typically falls to the landlord.

However, if the moisture is due to tenant behavior, like blocking vents or not running the AC sufficiently to manage the high humidity, the tenant may be liable. Your situation points strongly to an AC issue, given the unit's location and the persistent dampness. This is a common problem in Dubai's climate, where AC systems run year-round and condensation leaks are a frequent cause of hidden mold.

Your first step is to formally notify your landlord in writing with photos, as they must address issues that affect the property's habitability. Do not attempt to clean a large patch yourself, as disturbing it can spread spores. For a case this severe, a professional inspection is crucial to identify the exact moisture source. A certified mold assessor can provide a documented report linking the growth to the AC system, which is powerful evidence for your landlord. If the landlord is unresponsive, you can file a complaint with the Dubai Land Department's Rental Dispute Center.
