Is landlord responsible for bathroom mold in my apartment?« Back to Previous Page

We've lived in our Jumeirah Village Circle apartment for two years and just noticed black mold spreading along the bottom of the bathroom wall behind the toilet. It's been extra humid lately and I can't get the smell to go away no matter how much I clean. I'm worried about my toddler's allergies. Is this something I need to fix myself, or is the landlord responsible for repairing what seems like a hidden humidity issue?

In the UAE, specifically Dubai, the responsibility for bathroom mold remediation depends on the source of the moisture. Under the Dubai Rental Law (Law No. 26 of 2007), landlords are obligated to maintain the property's structural integrity and ensure it is habitable. If the mold growth is a result of a structural or maintenance-related issue, such as a hidden leaking pipe within the walls, a faulty sewage connection, or inadequate waterproofing and ventilation systems, the repair and subsequent mold remediation are unequivocally the landlord's responsibility.

However, the extreme humidity and constant air conditioning use in Dubai create a high-risk environment for condensation-related mold, especially in bathrooms. If the issue is solely due to a lack of tenant ventilation (e.g., not using the exhaust fan during and after showers), the responsibility for cleaning may fall to you. The black mold you describe behind the toilet is a significant red flag. This location is a classic hotspot for concealed leaks from water supply lines or wax ring seals, which are structural issues.

Given the persistent smell and the presence of a toddler with allergies, this is a serious health and safety concern. Stachybotrys (black mold) can exacerbate respiratory issues. Do not attempt to clean it yourself with bleach, as this can aggravate spore release and only addresses surface discoloration, not the root cause.

Your first step is to formally notify your landlord or property management company in writing about the issue, requesting an immediate inspection for the source of the moisture. We strongly recommend a professional assessment. Our certified inspectors at Saniservice use thermal imaging cameras and moisture meters to accurately identify the hidden source of water intrusion without destructive testing. This evidence is crucial for determining liability. For immediate consultation and to schedule a professional inspection, please call us at 800-MOLDS (800-66537) or email hello@saniservice.com.
