Is landlord responsible for bedroom wall dampness and mold?« Back to Previous Page

The wall behind my wardrobe in our bedroom has been getting these black spots for a couple of months now, and the dampness seems to be spreading after the recent humidity. We’re renting an apartment in Jumeirah Village Circle and our contract is pretty standard. Who is actually responsible for fixing this and paying for the repairs – is it me as the tenant or is my landlord supposed to handle it?

Under Dubai's rental law, the landlord is generally responsible for structural repairs and issues related to the building's envelope, which includes fixing the source of dampness in your wall. This is because the problem is likely due to a pre-existing condition, such as a hidden pipe leak or inadequate external waterproofing, that you did not cause.

Your first step is to formally notify your landlord or property management company in writing, with clear photos of the black spots and the spreading dampness. Mention that it has worsened with the recent high humidity. They are obligated to address the root cause, such as repairing a leak or improving insulation. Until the moisture source is fixed, any mold cleaning will be temporary.

However, the responsibility for the mold growth itself can become a grey area. While the landlord fixes the structure, you are typically responsible for maintaining general cleanliness. For a case like this, where the mold is a direct result of their unresolved damp issue, they should cover the full remediation. It is crucial to document all communication.

Given Dubai's climate, this is a common issue in JVC apartments. The constant AC use can create condensation if insulation is poor, and high humidity accelerates mold growth behind large furniture like wardrobes that restrict airflow. For your health and to verify the extent, a professional inspection is wise to identify the mold species and the exact moisture source. This provides a neutral, evidence-based report that can clarify responsibility between you and the landlord.
