Is landlord responsible for black mold cleanup and health issues?« Back to Previous Page

My kids have been coughing and I suspect it's the black mold that's been spreading in the master bedroom closet for the past couple of months, especially after that really humid period. We've lived in this Jumeirah Village Circle apartment for two years and it's just gotten worse. Is the landlord responsible for the cleanup and potential health issues, or is this on me as the tenant?

Under Dubai's rental law, landlords are generally responsible for maintaining the structural integrity of the property, which includes addressing leaks and moisture intrusion that lead to mold. Since the mold in your closet is likely due to a persistent humidity issue or a hidden leak, this is typically the landlord's responsibility to remediate.

You should formally notify your landlord in writing about the issue, as they are obligated to provide a habitable property. For health concerns, a professional inspection is critical to confirm the mold type and its source—often a leak in the AC drain line or building envelope exacerbated by our humid climate. This documented evidence is essential for any discussion about liability.

Regarding health issues, establishing a direct causal link for compensation is complex and requires medical documentation. Your immediate priority is to stop the moisture source and have the mold properly removed, not just wiped away, as this can aerosolize spores. For a case that's been spreading for months, DIY cleaning is not advised; professional remediation that includes containment and air scrubbing is needed to protect your family's health.
