Is landlord responsible for black mold cleanup in Discovery Gardens?« Back to Previous Page

My kids have been coughing and I suspect it's from the black mold I just found growing behind the wardrobe in our master bedroom in Discovery Gardens. We've lived here for 2 years and just noticed it, and the humidity has been awful lately. Is the landlord responsible for the cleanup and the cost of an air quality test, or is this on me to fix?

Based on the Dubai Rental Law (Law No. 26 of 2007) and subsequent regulations, the responsibility for maintenance and repairs of the property's main structure falls squarely on the landlord. This includes issues arising from inherent building defects, such as faulty waterproofing, leaking central AC systems, or structural problems that lead to persistent dampness—the primary catalyst for the black mold (likely Stachybotrys chartarum) you've discovered behind the wardrobe.

Given Discovery Gardens' high humidity levels and the prevalence of 24/7 AC use, condensation within wall cavities is a common failure point. If the mold growth is a direct result of such a structural or systemic issue, your landlord is legally obligated to address the root cause and the resulting mold remediation. However, if the cause is determined to be tenant-related (e.g., lack of ventilation, indoor drying of clothes, blocking AC vents with furniture), the financial responsibility may shift.

Crucially, you must not attempt to clean this yourself. Disturbing toxic black mold releases harmful mycotoxins into the air, exacerbating respiratory issues like the coughing your children are experiencing. The first step is a professional indoor air quality (IAQ) test and a thorough inspection to identify the exact moisture source and mold species. This certified report is essential evidence to formally present to your landlord, outlining the required remedial actions.
